According to the filed complaint, the action arises from events that occurred during a residential treatment stay at The Pointe Malibu Recovery Center in Malibu, California.
The complaint states that the plaintiff paid approximately $50,000 for a 15-day residential treatment program and was assigned to a private room described as a "Deluxe Suite."
Court records reflect that the plaintiff was admitted to Providence St. John's Hospital in Santa Monica during the time period referenced in the complaint, which includes claims related to the plaintiff's treatment, the conditions of the premises, and ongoing and potentially permanent health effects.
The complaint asserts multiple causes of action, including negligence, negligence per se, premises liability, fraud and intentional concealment, negligent misrepresentation, professional negligence, breach of fiduciary duty, intentional infliction of emotional distress, negligent infliction of emotional distress, breach of contract, breach of the implied covenant of good faith and fair dealing, and rescission.
