Goings Law Firm Secures $600,000 Jury Verdict for Client Hit By Concrete Truck

The case stemmed from a preventable accident caused by a distracted truck driver employed by Concrete Supply Co. Edward O’Neal was stopped at a red light when his four-door sedan was hit from behind by Michael Landry, leaving O’Neal disoriented and suffering from neck and back pain serious enough that emergency responders took him to Lexington Medical Center for treatment.

O’Neal’s pain worsened in the days and weeks after the accident, and he sought additional treatment from both his regular physician and a chiropractor. The chiropractor ordered an MRI, which revealed O’Neal was suffering from a disc herniation that caused a disc to impinge on a nerve root. O’Neal then saw a spinal specialist who confirmed that the injury was caused or exacerbated by the collision with the concrete truck.

The defendant hired medical and reconstruction experts to help them argue in court that the impact was minor and could only have resulted in soft-tissue injuries that would have healed in a week or two. In their closing arguments, they asked the jury to award a paltry $10,500 in damages. Instead, the jury sided with the Goings Law Firm and their client, agreeing that the driver had been reckless and grossly negligent. They awarded $575,000 in compensatory damages and $25,000 in punitive damages, for a total verdict of $600,000.
